Presentation on Proposed Conservation Overlay

  • Conservation Overlay –Josh Palmeri, Denver Planning Department
  • This is a zoning tool, that helps to preserve neighborhood character and scale for new construction. This is not an historical designation, or establishing an HOA.
  • Affects only new construction and becomes the new zoning code
  • List of zoned areas affected and those not included (see overlay proposal for details)
  • Overlay includes 8 zoning change proposals:
  • With a demolition permit, up to 40% of a house could be demolished; overlay would allow only 10% of the front façade to be demolished
  • Maintain side setbacks
  • Minimal reduction of height in some cases
  • Minimal decrease in the lot coverage allowance
  • Allow dormers to pierce bulk plane
  • Requires front setback on second floor for low slope or flat roof
  • Maintains front porches
  • Requires a minimum first floor elevation
  • No impact to pop tops (these are not new construction)
  • Encourages infill to align with the character of the neighborhood
  • Allows a homeowner making no change to continue to enjoy their current levels of light and space
  • Questions and discussion included how this is not a new idea, that other Denver neighborhoods have succeeded in placing overlays that preserve the characters of their neighborhoods.

  • December 11 will be our annual membership meeting, look for an invitation and register. Tell a neighbor, too, especially a new one!
  • Updates on Congress Park.- Public Health announcement: Contractor for BRT has applied for a variance that would allow construction noise 24/7 for four years along the Broadway to Yosemite construction zone. There will be a meeting in November on this issue. Please inform yourself, participate in meetings, and make your voice heard. This will affect more than just neighbors in the 1400 blocks.
